People shouldn’t be having sex in public parks, but when they are prosecuted, it should be in a symmetrical fashion. This smacks of sexism.
I also don’t quite agree with Ed Morrissey’s evaluation of what probably happened. It sounds like they were making out (hence, the “kissing”), and went on to either a hand-situation or a full-out conventional penetration with the woman on the man’s lap, and the action “hidden” (or so they rationalized it) by the woman’s skirt.
If either my diagnosis or Ed’s is correct, public lewdness was the appropriate charge, here—for both participants. Or, perhaps, a stern talking-to by the cops, and an extraction of a promise never to mess around in public ever again. How often are charges actually brought in these cases? I mean, I know a woman who works in law enforcement who isn’t above . . . um . . . car-related activity with her husband in the dark by the side of the road, if the area is secluded enough. And I’ve wished I had the nerve, though perhaps hanging out with cops is a nice insurance policy for this person. (I gotta go: my spouse and I are playing “picnic table” tonight—in the condo.)

Being from the area I can offer a comment. The law gave the man involved a loophole. You can only be charged with adultery if you know one of you is married. He did not know she was married.
The woman has spoken on camera a couple of times now with varying stories. As best as I can figure out, she was either on his lap with partial skirt coverage or was performing orally. Either way, it was obvious to the police who arrived and to the woman who called them.
This was not an isolated spot. It was a public park full of people on a nice summery day in upstate NY.
